This SMS and Text Messaging Terms and Privacy Notice governs your participation in BambooHR’s SMS and text messaging program (“SMS Program”) and describes how BambooHR, Inc. (“BambooHR,” “we,” “us,” or “our”) collects, uses, and protects Personal Information in connection with that program. This SMS and Text Messaging Terms and Privacy Notice also supplements BambooHR’s General Privacy Notice and California Privacy Notice.

Part I: Terms and Conditions

Program Description
By opting into the BambooHR Marketing SMS Program, you agree to receive text messages from BambooHR at the mobile phone number you provide. Messages may include marketing communications, event reminders, appointment reminders, and other information related to BambooHR offerings.

User Opt-In and Consent
You opt into the SMS Program by providing your mobile phone number and affirmatively indicating your consent through our website, forms, or other enrollment methods. By opting in, you confirm that you are authorized to use the mobile phone number provided, you consent to receive SMS messages that may be sent using automated technology, and your consent is not a condition of any purchase.

Message Frequency and Timing
Message frequency varies based on your interactions with BambooHR and the SMS Program. You may receive up to six (6) promotional messages per month. Messages are generally sent between 8:00 a.m. and 6:00 p.m. in the recipient’s local time zone.

Message and Data Rates
Message and data rates may apply depending on your mobile carrier and service plan. BambooHR is not responsible for any charges imposed by your carrier. Mobile carriers are not liable for delayed or undelivered messages.

Opt-Out Instructions
You may opt out of the SMS Program at any time by replying STOP to any text message. After you opt out, you will receive a confirmation message and will no longer receive SMS messages from BambooHR unless you choose to re-enroll.

Supported Carriers
The SMS Program is supported by most major U.S. mobile carriers, including AT&T, Verizon, T-Mobile, and Sprint, among others. Supported carriers may change without notice. Carriers are not responsible for delayed or undelivered messages.

Eligibility
You must be at least 18 years old and reside in the United States to participate in the SMS Program.

Changes to the Program or Terms

We may modify or discontinue the SMS Program or these Terms at any time. Changes will be effective when posted. Your continued participation in the SMS Program after changes are posted constitutes acceptance of those changes.

Part II: Privacy Notice

Information We Collect
If you opt in to receive text messages from BambooHR, we may collect your mobile phone number, your SMS opt-in and opt-out status, message interaction data (such as delivery confirmations and responses, including STOP or HELP), and the content of SMS communications you exchange with us.

How We Use SMS Information
We use SMS-related Personal Information to send you messages you have consented to receive, provide customer support, operate and improve the SMS Program, and comply with applicable legal and regulatory requirements.

Sharing of SMS Information
We do not share or sell your SMS consent information. We may share SMS-related Personal Information with trusted service providers who help us operate and deliver the SMS Program, subject to confidentiality and security obligations. We may share your mobile number for other purposes permitted under applicable laws and regulations, but not for SMS and text purposes.

U.S. State Privacy Rights
If you are a resident of certain U.S. states, including California, you may have additional rights regarding your Personal Information. BambooHR does not sell or share Personal Information collected through the SMS Program for other reasons, including cross-context behavioral advertising. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect SMS-related Personal Information.
