Modification of Service or the Agreement
Can BambooHR modify the functionality of its services? (3.1)
BambooHR may, at its discretion, modify, add, or remove portions of the service. BambooHR will not make modifications that materially diminish the features or functionality of the Service. From a practical perspective, BambooHR wants to ensure its services meet the needs of its customers and would not want to modify the service in a way that would materially impact the capabilities and/or functionalities its customers use in the services.
Can BambooHR update the Terms of Service? And why would BambooHR update the Terms of Service ? (3.2)
Yes, BambooHR reserves the right to update the Terms of Service at any time. Historically, BambooHR has updated the Terms of Service for reasons such as new laws that are applicable to our services, to clarify wording or terms, to account for new products or services, and to address any abuses of services offered. BambooHR will provide 30 days notice to our customers of any material modifications to the Terms of Service. For customers with a Month-to-Month Subscription, such modifications will take effect on the date that is 30 days after the date of the notice. For customers with an Extended Term Subscription, if any material modifications are made to this Agreement, such modifications will not take effect until the beginning of the next renewal term. Any updates that may occur due to new services being offered will be applicable to you when you start to use such new services (this applies to both Month-Month customers and Extended Term customers).
What if I don’t accept updates or changes to the Terms of Service? (3.3)
BambooHR is happy to answer any questions you may have and clarify any modifications that were made to the Terms of Service. Ultimately, if you are a Month-to-Month Subscription customer and can’t agree to the modifications, you may terminate the services, without penalty, in accordance with the Terms of Service. If you are an Extended Term Subscription customer, any material modifications will not take effect until the next renewal term. If you can’t agree to the modifications, you may provide notice of non-renewal in accordance with the Terms of Service.
