These Terms of Service FAQs are for informational purposes only—they are not contractual or binding in nature. These FAQs should not be seen as a substitute for reading and understanding BambooHR’s Terms of Service. Please see section 17.6 of the Terms of Service for additional information.

What is the term (length) of our agreement and how does renewal work? (2.1, 2.2, and/or 5.1)

Your applicable Order Form specifies your term length and whether you are on a Month-to-Month Subscription or an Extended Term Subscription. If you have selected our Month-to-Month Subscription model, your contract is a contract of indefinite duration and your subscription will renew on a month-to-month basis and continue until either party elects to terminate the contract. If you have selected our Extended Term Subscription model, your contract has a specified duration and will automatically renew for 12 month Terms unless you provide notice of non-renewal

Under what circumstances would I lose access to my BambooHR services? (2.4)

BambooHR reserves the right to suspend your access to the service due to non-payment or violations of the Terms of Service. Given the fact that the Terms of Service provides you with the right to use our service, it is not an uncommon market practice to revoke such a right if the contract is being violated. So long as you pay your bill on time and abide by the terms contained in the Terms of Service, this should not be an issue.

Are there any companies or industries that BambooHR will not provide services for? (2.4)

BambooHR may choose not to serve certain companies or industries it believes may raise legal, regulatory, or other concerns that might divert its attention away from its mission and serving its customers.

How long do you maintain my data? What happens to my data when my account is terminated? (2.5)

BambooHR will maintain customer data as long as the service is being properly used and terms are followed. After a customer account is terminated, customer data will be available for download for the next 30 days, after which customer data will be deleted. If you use our payroll services, customer data related to the payroll services will be maintained for 7 years to fulfill our legal and tax obligations regarding our payroll services.
