This Addendum (the "Addendum") is hereby incorporated into the BambooHR Terms of Service (the “Agreement”) by reference and shall apply in connection with Customer's purchase and use of Turn Services through the BambooHR® platform. For purposes of this Addendum: (a) "Turn" shall mean Turn Technologies, Inc. and its Affiliates, and (b) "Turn Services" shall mean the software-as-a-service product(s) of Turn described at www.turn.ai. Customer acknowledges and agrees that, with respect to Customer's use of the Turn Services, the following terms and conditions in this Addendum shall apply in addition to the terms set forth in the Agreement:

1. Customer represents and warrants that it has received all third-party consents and approvals required under the Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq., California's Investigative Consumer Reporting Agencies Act ("ICRAA"), Ca. Civil Code § 1786 et seq., and all other applicable laws. Customer also represents and warrants that it has received all third-party consents or approvals required under applicable law for Turn to place calls or send text messages to a person's mobile telephone number using any automatic telephone dialing system, including but not limited to obtaining any required consent under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227 et seq.

2. Customer agrees to Turn's Terms of Use and Privacy Policy, both of which are available at https://www.turn.ai/. Customer certifies that: (a) any requested background report will be used for employment purposes and no other purpose; (b) should its purpose change, it is obligated to notify Turn immediately; (c) the applicant has been provided all required disclosures and the applicant's authorization to generate a background report has been obtained in accordance with the FCRA, the ICRAA, and other applicable law; (d) Customer will, as applicable, follow pre-adverse and adverse action process required by the FCRA, the ICRAA, and all other applicable law; and (e) Customer will not use any of the information contained in the background report in violation of any state or federal equal employment opportunity or other applicable laws.

3. Customer acknowledges and agrees that no provision of the Agreement or this Addendum is intended to, nor shall it be interpreted to, provide any rights of any kind for Customer against Turn as it relates to services received by Customer under the Agreement. Customer acknowledges and agrees that Turn shall be a third-party beneficiary to the Agreement, is entitled to the rights and benefits of the Agreement and may enforce the provisions of the Agreement directly as if it were a party thereto, in each case as it relates to the Turn Services. Customer acknowledges and agrees that BambooHR shall be a third-party beneficiary to Turn's Terms of Use and Privacy Policy, is entitled to the rights and benefits of Turn's Terms of Use and Privacy Policy and may enforce the provisions of Turn's Terms of Use and Privacy Policy directly as if it were a party thereto. Bamboo HR shall be permitted to disclose the terms of the Agreement, including this Addendum, to Turn as evidence of Customer's agreement to abide by the terms therein.
